Determine Constraints

4-41. This is a critical step in HUMINT mission analysis. HUMINT collection operations are affected by applicable law and policy. Applicable law and policy include US law; the law of war; relevant international law; relevant directives including DOD Directive 3115.09, “DOD Intelligence Interrogations, Detainee Debriefings, and Tactical Questioning”; DOD Directive 2310.1E, “The Department of Defense Detainee Program”; DOD instructions; and military execute orders including FRAGOs. The degree of restriction may depend on the type of operation being conducted. Constraints are normally found in the scheme of maneuver, the concept of operations, and coordinating instructions. Specific to intelligence interrogation operations, in accordance with DOD Directive 3115.09, “all captured or detained personnel shall be treated humanely, and all intelligence interrogations or debriefings to gain intelligence from captured or detained personnel shall be conducted humanely, in accordance with applicable law and policy. Acts of physical or mental torture are prohibited.”
